Why we are fighting

Lucky Machines’ April 15, 2024 Notice of Opposition does more than assert earlier rights and likely confusion. In a separately captioned ground, it alleges that representations made to the USPTO on Mattel’s behalf were false, known to be false, material, and made with intent to obtain publication and registration of HOT WHEELS RACERVERSE.
The representations
The filing identifies statements in the application concerning other parties’ rights and whether the application’s factual contentions had support after an inquiry reasonable under the circumstances.
Falsity and knowledge
Lucky Machines alleges those representations were false and alleges Mattel knew of Racerverse and Lucky Machines’ prior use when the representations were made.
Intent to deceive
The Notice alleges the representations were made on Mattel’s behalf to mislead the USPTO and induce approval of the application for publication and registration.
Materiality and relief
The Notice alleges the representations were material and asks the Board to sustain the opposition and deny Application Serial No. 97708782 in its entirety.

Under In re Bose Corp., trademark fraud requires a knowingly false, material representation made with intent to deceive the USPTO; the allegation must ultimately be proved with clear and convincing evidence.
